The petitioner seeks bail in G.R.P. Darbhanga P.S. case No. 81 of 2016 under Section 414/34 of the Indian Penal Code and under Section 137/147 of the Railway Act. The petitioner along with another one was apprehended and from the possession of petitioner two mobiles were recovered.
The learned counsel for the petitioner submits that no case of theft of aforesaid mobiles was registered anywhere. Of course, the petitioner has got criminal antecedent but he is in custody since 21.09.2016. The petitioner has already remained in jail for about seven months.

No.14882 of 2017 (2) dt.19-04-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (Railway), Samastipur in G.R.P. Darbhanga P.S. Case No. 81 of 2016.
