The petitioners seek bail in a case registered under Sections 366A/34 of the Indian Penal Code and Section-8 of the POCSO Act.

The prosecution case in brief is that the informant's daughter was kidnapped by the accused persons. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 23-09-2018. Charge sheet has already been submitted. The petitioners have

Patna High Court CR. MISC. No.9598 of 2019(3) dt.15-04-2019 2/2 been falsely implicated in the present case. The victim in her statement recorded u/S 164 Cr.P.C. has not supported the allegation made in the FIR.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 188 of 2018.
