JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 14-07-2026 Heard learned counsel for the petitioner, learned APP for the State, learned counsel for the informant and perused the case diary.
2. The petitioner seeks bail in connection with Balthar P.S. Case No. 54 of 2025, instituted for the offences punishable under Sections 137(2), 140(3), 96, 142, 98, 64, 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 4 and 6 of POCSO Act.
3. The prosecution case, in short, is that acting on a tip-off on 30.04.2025, authorities rescued a minor girl who revealed that a co-villager, Vikash, had conspired to traffic her
Patna High Court CR. MISC. No.12100 of 2026(8) dt.14-07-2026 2/3 to Nepal through the petitioner. The petitioner took her by train to Sikta, where he sexually assaulted her and threatened her life when she resisted.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submits that the victim is a married woman who was in love with the co-accused, Vikash and out of her will she left her matrimonial house in order to live with the co-accused. It is next submitted that the petitioner has neither kidnapped the victim nor sexually assaulted her. It is further submitted that the statements of the victim recorded under Sections 180 and 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 are contradictory and there is no any medical report in support of her allegation of rape committed by the petitioner. The petitioner is in custody since 01.05.2025 and has got no criminal antecedent.
5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner. It is further submitted that there is specific allegation levelled against the petitioner and the victim has supported the prosecution case in her statement recorded under
Patna High Court CR. MISC. No.12100 of 2026(8) dt.14-07-2026 3/3 Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
6. Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.
7. The prayer is rejected. The trial Court is directed to expedite the Trial.
