In the instant petition, petitioner has prayed for following reliefs:- "That this is an application for issuance of writ in the nature of writ of certiorari, Mandamus or any other appropriate writ or writs, order or direction commanding respondents and to quash the "Tender Notice" dated 21.07.2018 issued from the office of the D E O (Establishment) Vaishali under the signature of District Programme Officer (hereinafter referred as DPO) Vaishali (Annexure 3) by which a Tender for supply of "Panji

Patna High Court CWJC No.15842 of 2018 dt.24-03-2023 2/2 Prapatra" (Register and Forms) has been sought specifically from the entrepreneur carrying "Small Enterprises" as per Government approval but the respondent no. 4 and 5 have played malafide and has violated the equality clause of Article 14 and 16 of the Constitution of India by putting terms and conditions in favour of persons carrying "Big Enterprises" and belong to different class to cause prejudice to small entrepreneurs which is completely illegal malafide and capricious in nature and is liable to be quashed by this Hon'ble Court."

3. There is no interim order in so far as tender notice dated 21.07.2018.

4. Learned counsel for the respondent on instruction submitted that process of tender notice dated 21.07.2018 has attained finality.

5. Such statement is taken on record.
