The petitioner is languishing in custody since 18.09.2015 in a case registered for the offences punishable under Sections 20, 22 and 23 of the NDPS Act.

The petitioner and co-accused Ramesh Prasad were apprehended. From Ramesh Prasad one bag was seized containing 4 kgs. of Charas, Nepali currency, mobile and other articles, who confessed that he was carrying the alleged contraband given by Mahendra Chaurasia. The petitioner was accomplice of the apprehended co-accused Ramesh Prasad. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.1186 of 2016 (3) dt.30-01-2016 2/2 petitioner that the recovery has not been made from the possession of the petitioner. This fact has not been controverted by learned APP after going through the case diary. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and now the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with NDPS Case No. 18 of 2015 arising out of Kangali P.S. Case No. 44 of 2015.
