1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Dalsinghsarai P.S. Case No. 184 of 2023 dated 15-04-2023 registered under Sections 366(A) / 34 of the I.P.C.
3. As per the F.I.R. on 13.04.2023 the informant's sister had gone to the field but she did not return. Upon search, the informant came to know that petitioner along with others have kidnapped her sister aged about 16 years.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of concocted story. There was love relationship between the

The statement of the victim girl was recorded under Section 164 of the Cr.P.C. in which she has stated that her mother wanted to perform marriage of the victim along with another boy so she fled away with the petitioner and solemnized marriage at Haryana. The marriage certificate of Arya Samaj Mandir and affidavits thereto are annexed at Annexure- 2 to this application. Learned counsel further submits that the victim is not minor and was major as on the date of occurrence which would be evident from the birth certificate of the victim annexed at Annexure- 3.
5. Regard being had to the submission made by the parties, taking into consideration the submission advanced by learned counsel for the petitioner and the statement of the victim girl recorded under Section 164 of the Cr.P.C., I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st Class, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 184 of 2023 subject to the condition
