The petitioner is in custody in connection with Bettiah Town P.S. Case No. 468 of 2018 for the offences under Sections 456, 457, 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 20.12.2018. He further submits that allegation against the petitioner is that he was involved in cutting of ATM for committing loot. He further submits that the name of the petitioner was disclosed by the co-accused Badrul Emam who have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 56540 of 2018 vide order dated 04.10.2018 and other

Patna High Court CR. MISC. No.12093 of 2019(2) dt.27-02-2019 2/2 co-accused Yash Verma @ S. Varma has also been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 55773 of 2018 vide order dated 08.10.2018.

Considering the fact that similarly circumstanced other co-accused including Badrul Emem have been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S.
