The petitioner apprehends his arrest in Kadwa P.S. Case No. 302 of 2016 instituted for the offence under Section (s) 498A, 376/511 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The petitioner is alleged to be father-in-law of the informant. There is general and omnibus allegation against this petitioner that he tried to commit rape with the informant. It has been submitted that petitioner is living separately with his son and he has no concern with his son or his family members.
It has been mentioned in para 3 of the petition
Patna High Court Cr.Misc. No.13023 of 2017 (2) dt.23-03-2017 2/2 that petitioner has no criminal antecedent.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Kadwa P.S Case No. 302 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Katihar, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
