The petitioner being PDS dealer is apprehending arrest in a case registered for the offences punishable under section 7 of the E.C. Act.
The petitioner was found carrying 14 bags of government supply rice when it was suspected that the petitioner was taking the rice for sale in black market. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. In pursuance to the lodging of the present case, the licence of the petitioner was cancelled but the order of cancellation of licence has been set aside in a writ proceeding. Statement has been made
Patna High Court Cr.Misc. No.4681 of 2016 (2) dt.04-02-2016 2/2 in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Udakishunganj P.S. Case No. 195 of 2015 pending in the court of learned SDJM, Udakishunganj. This application is disposed of with the aforesaid observation/direction.
