The petitioners apprehend their arrest in connection with Wazirganj P.S. Case No. 45 of 2017 for the offence punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the informant and his wife resulting in them being inflicted with various kinds of injuries. The learned counsel for the petitioners has submitted that the petitioners are innocent, have been falsely implicated in the present case and are having a clean antecedent.

No.8926 of 2020(2) dt.29-02-2020 2/2 It is further submitted that though the petitioners have been named in the FIR but no specific allegation of overt act has been levelled against them, hence, it is apparent that they have been falsely implicated in the present case Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to direct for release of the petitioners on anticipatory bail. Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail-bonds of Rs. 10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-Ist, Class, Gaya with Wazirganj P.S. Case No. 45 of 2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) K.K.RAO/- U T
