The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 304B, 302, 34 of the Indian Penal Code.

The allegation against the petitioners along with coaccused persons is that they have committed murder of the daughter of the informant due to non-fulfillment of dowry demand.

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. The petitioners are mother-in-law and sister-in-law of the deceased

Patna High Court CR. MISC. No.10033 of 2023(2) dt.03-05-2023 2/2 due to which they have falsely been implicated in this case. The petitioners have no concern mess and business of the deceased as well as her husband and living separately from both of them. Not a single witness has stated about the complicity of the petitioners in this alleged occurrence. It is further submitted that the petitioners have got not criminal antecedent moreover, they are languishing in judicial custody since 13.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Balua Bazar P.S. Case No. 53 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Supaul.
