JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2019 This is an application for grant of anticipatory bail in connection with Phulwarisharif P.S. Case No. 679 of 2018 and G.R. No. 5895 of 2018, disclosing offences under Sections 498(A), 323, 504, 506 of the Indian Penal code and 3⁄4 of the Dowry Prohibition Act.

Allegation against the petitioner is that he ousted the informant with respect to demand of dowry and subjected her to cruelty and assault also.

Submission of learned counsel for the petitioner is that as a matter of fact, the marriage was love marriage, however, the petitioner is still ready to keep the opposite party no.2, but the opposite party no.2 is not ready to live along with the petitioner and she has filed a divorce case also.

Patna High Court CR. MISC. No.10777 of 2019(3) dt.26-04-2019 2/2 Heard learned A.P.P. as well as learned counsel for the opposite party no.2, who has submitted that opposite party no.2 is not ready to reside with the petitioner rather she wants divorce from the petitioner and for that she has filed a Matrimonial Case No. 1255 of 2018 which is pending in the court of Family Judge, Patna. Having heard both sides, in view of the facts and circumstances of the case as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJMXV, Patna in connection with Phulwarisharif P.S. Case No. 679 of 2018 and G.R. No. 5895 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure and further condition that the the petitioner will cooperate in disposal of the said Matrimonial Case No. 1255 of 2018.

Learned Principal Judge, Family Court, Patna is directed to expedite the proceeding and try to dispose of the same within a period of seven months and both the parties have to cooperate in the disposal of the case.
