The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 406, 467, 468, 209, 193, 471/34 of the Indian Penal Code. As per prosecution case, Ravi Kumar Kevat, husband of the petitioner, was accused in connection with Pavapuri P.S. case no. 236/2022 who remained in prison. At the time of investigation in J.J.B.658/2022, this fact came to light that instead of surrendering himself, accused husband of the petitioner along with this petitioner Kajal Kumari, surrendered his brother-in-law's son to save himself from the crime of murder.

Patna High Court CR. MISC. No.13382 of 2023(2) dt.25-04-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner, being a lady, has falsely been implicated in this case. As a matter of fact, the petitioner went to the Court on being informed that her sister's son has falsely been implicated in any false case and she is called by the advocate for some paper work other than this fact, the petitioner had no knowledge about her nephew is being shown as her husband. It is further submitted vide para 8 of the petition that in course of the investigation, no role of the petitioner has been assigned except that, the other boy happens to be nephew of the petitioner. The petitioner has got no criminal antecedent and languishing in judicial custody since 18.8.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as the petitioner is being a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihar P.S. Case No. 596 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
