JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This is an application for grant of anticipatory bail in connection with Deepnagar P.S. Case No. 04 of 2019, disclosing offences under Sections 147, 148, 149, 341, 342, 323, 307, 290, 291, 353, 427 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per F.I.R. is that there was an altercation took place between two groups and when the police reached at the place of occurrence, both parties attacked on the police party and some of them made firing causing injury to one police personnel.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and he has been named in this case along with some other accused persons.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Deepnagar P.S. Case No. 04 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
