The petitioner seeks bail in connection with Bathnaha P.S. Case No. 152 of 2014 registered for the offences punishable under Sections 363 & 366A/34 of the Indian Penal Code.
It is contended that the petitioner is in custody since 03.06.2014. On completion of investigation, the police submitted charge-sheet pursuant to which cognizance was taken and charges were framed against the petitioner on 06.04.2015, but till date, no witness has been examined on behalf of the
Patna High Court Cr.Misc. No.970 of 2016 (2) dt.13-01-2016 2 / 2 prosecution.
Regard being had to the observations made in the aforesaid order dated 22.10.2014 passed in Cr. Misc. No. 39947 of 2014 whereby the prayer for bail of the petitioner was earlier rejected by this Court, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Sitamarhi in connection with Sessions Trial No. 545 of 2014 arising out of Bathnaha P.S.
