2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 354(B), 376, 377/34 of Indian Penal Code and Sections 66(C), 66(E), 67, 67(A) of the Information Technology Act.
3. As per the prosecution case, the petitioner was found watching obscene video of one lady who was involved in unnatural sex.
4. Learned counsel for the petitioner submits that the victim in her statement, recorded under Section 164 of Cr.P.C., has denied the prosecution case and has categorically stated her photograph was wrongly made viral with intention to tarnish her image and no wrong act has been committed with her by the

5. Considering the statement of the victim recorded under Section 164 of Cr.P.C., this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Khagaria in connection with Parbatta P. S. Case No. 416 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
