The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 1072.8 lites of IMFL was recovered from the truck and 254.56 litres of IMFL was recovered from the Scorpio vehicle. The petitioner was taken into custody.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No incriminating article has been recovered from the petitioner's possession nor from the vehicle in question. He is in custody
Patna High Court CR. MISC. No.10471 of 2022(3) dt.17-05-2022 2/2 since 25.11.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parities and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for five months, the petitioner above-named, is directed to be enlarged on bail in connection with Pupri P.S. Case No. 386 of 2021 on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court-II, Sitamarhi.
