The petitioner apprehends his arrest in connection with Uchakagaon P.S. Case No. 43 of 2019 for the offence registered under Sections 363, 366A/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having helped the co-accused Rajesh Sah to kidnap the minor victim girl for the purposes of solemnizing marriage.

The learned counsel for the petitioner has submitted that the petitioner has got no complicity in the matter and in fact the said co-accused person, namely, Rajesh Sah has already married the victim girl. It is further submitted that the father and mother of the said co-accused Rajesh Sah, have

Patna High Court CR. MISC. No.8908 of 2020(2) dt.29-02-2020 2/2 already been granted bail by a coordinate Bench of this Court vide order dated 01.10.2019 passed in Criminal Misc. No. 38514 of 2019. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case and considering the submissions of the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIXth, Gopalganj in connection with Uchakagaon P.S. Case No. 43 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
