2. The petitioner has preferred this application for grant of regular bail in connection with Rauta P.S. Case No. 185 of 2024 dated 10.08.2024 registered for the offences punishable under Sections 103(1), 80 read with Section 3(5) of BNS.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed murder of the informant's niece.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the husband of the deceased. There is no specific allegation against the petitioner. There is general and omnibus allegation against the petitioner. The charge-sheet has been submitted against the petitioner. The petitioner has no
Patna High Court CR. MISC. No.14730 of 2025(2) dt.22-03-2025 2/2 concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.08.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitted that the specific allegation against the petitioner is that he along with other coaccused persons committed murder of the informant's niece. As per post-mortem report, the doctor has kept the opinion reserved regarding the cause of death but doctor has found ligature mark on middle of her neck.
6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Rauta P.S. Case No. 185 of 2024, pending in the Court of learned Court concerned, Purnia.
7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
8. The application stands rejected.
