This is a petition for grant of regular bail for offences under Sections 272, 273 and 308 of the Indian Penal Code and 47(A) of the Bihar Excise Amendment Act, 2016.

From the house of the petitioner 240 liters of country made liquor was recovered by the authorities. Submission of the petitioner is that no one was there in the house at the time of recovery. The petitioner has got no criminal antecedent and is in custody since 17.11.2016. Charge sheet has already been submitted in this case and the petitioner would fully cooperate with the investigation of the case.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand)

Patna High Court Cr.Misc. No.9793 of 2017 (2) dt.07-03-2017 2/2 with two sureties of the like amount each in connection with Runnisaidpur P.S. Case No. 127 of 2016 to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, or successor Court with the condition that if it would be brought to the notice of the learned Court below that the petitioner is indulged in similar type of case in future, the Court below shall be at liberty to cancel the bail bond of this case also.
