JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-03-2017 The petitioner is in custody since 07.02.2017 in connection with Special Case No. 01 of 2017, arising out of Excise Case No. 220 of 2016-17, registered for offences punishable under Sections 20(b) of N.D.P.S. It has been submitted on behalf of the petitioner that a very small quantity of 150 Gram ganja has been recovered from the petitioner, however he has sufficiently been punished for the said offence as he has been in judicial custody since 07.02.2017 and has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, at present, I am not inclined to grant the petitioner the privilege of regular bail, it is accordingly rejected.
