Petitioner happens to be husband of the informant. Although, the informant stated in her statement recorded under section 164 of the Cr.P.C that she was subjected to cruelty and torture by the petitioner after solemnization of marriage but she has, nowhere, stated about story of rape.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, East Champaran at Motihari in Dhaka P.S. Case no. 252/2015. shahid (Hemant Kumar Srivastava,J) U T
