The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 447, 323 and 302/34 of the Indian Penal Code.
Petitioners along with four other persons is said to have assaulted the informant and his father on a row of construction of toilet on his land and sustaining injury the father of the informant died.
It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place.
Patna High Court CR. MISC. No.9813 of 2020(3) dt.22-06-2020 2/2 Petitioners have been falsely implicated in this case due to land dispute. Both the parties are gotias. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. Petitioners have no criminal antecedent. Similarly situated co-accused, namely, Raj Kishore Rai @ Misti Rai has been enlarged on regular bail by a coordinate Bench of this Court vide order dated 26.09.2019 passed in Cr. Misc. No.56917 of 2019, while Abhay Kumar has been enlarged on anticipatory bail vide order dated 11.12.2019 passed in Cr. Misc. No.81103 of 2019.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Sonepur P.S. Case No.1212 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
