The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 3963.60 litres of liquor was recovered from the truck being driven by this petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from possession of the petitioner or from the petitioner's vehicle. He is in custody since 10.1.2021 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, the petitioner is

Patna High Court CR. MISC. No.20511 of 2021(3) dt.05-10-2021 2/2 directed to be enlarged on bail in connection with Baisi P.S. Case no. 12 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnea.
