JUSTICE SATYAVRAT VERMA ORAL ORDER 29-09-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. In compliance of the order dated 05.09.2022, the petitioner and the informant are present physically present along with their respective counsels.

At the outset, the petitioner who is present in person submits that he is willing to pay an amount of Rs. 8,000/- to the informant towards monthly maintenance till any Court of competent jurisdiction finally adjudicates or decides the maintenance amount.

The informant who is present accepts the offer given

Learned counsel for the informant submits that today itself he will WhatsApp the bank account number of the informant to the learned counsel for the petitioner. Learned counsel for the petitioner submits that he will immediately WhatsApp the said bank account number to the petitioner in which the monthly maintenance shall be deposited which will commence from the month of October, 2022. The petitioner submits that he will be paying the said amount on or before 15th of every month commencing from October 2022.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Buxar Mahila P.S. Case No. 77 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

In the event, if the informant files an application

No.10041 of 2022(4) dt.29-09-2022 3/3 before the learned trial Court bringing to its notice that the petitioner for two consecutive months, as agreed, has not paid the maintenance amount, the learned trial Court shall forthwith cancel the bail bonds of the petitioner and take him into custody after recording reasons.
