2. The petitioner has preferred this application for grant of regular bail in connection with Rupaspur P.S. Case No. 311 of 2023 dated 27.04.2023 registered for the offence/s punishable u/ss 302 and 120(b)/ 34 of the IPC and sections 25(1-b)a, 26, 35 and 27 of the Arms Act.

3. As per the prosecution case, the co-accused persons are alleged to have committed murder of the informant's son due to previous enmity.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is nothing material on the record except

Similarly situated co-accused has already been granted anticipatory bail by this court vide order dated 30.01.2024 passed in Cr. Misc. No. 85282 of 2023. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.12.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur in connection with Rupaspur P.S. Case No. 311 of 2023.

7. The application stands allowed.
