NILU AGRAWAL ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 19.07.2016 in connection with Birpur (Bhimnagar O.P.) P.S. Case No. 156 of 2016, G.R. No. 540 of 2016 registered for the offence punishable under Section 394 of the Indian Penal Code.

The prosecution case is that while the informant was returning home after closing his shop, two unknown persons snatched Rs. 10,000/- and a Nokia mobile and also assaulted him.

It has been submitted by the learned counsel for

No.6021 of 2017 (3) dt.13-04-2017 2/3 the petitioner that he is innocent and just because he has criminal history and on the restatement of the informant that his son had seen him loitering near his shop, petitioner has been made accused. He submits that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence and that no Test Identification Parade has been done so far.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, District Supaul in connection with Birpur (Bhimnagar O.P.) P.S. Case No. 156 of 2016, G.R. No. 540 of 2016, subject to the condition that one of the bailors would be close relative and other bailor would be a person, who has sufficient immovable properties within the jurisdiction of the concerned police station/ Court and that petitioner will appear before the police/ Court below on each and every date and his failure to appear before the learned Court below on two consecutive
