The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and 4/5 of The Prize Chits and Money Circulation Schemes (Banning) Act, 1978.
The prosecution case is that on the persuasion of the petitioner and others the informant
Patna High Court Cr.Misc. No.4019 of 2016 (2) dt.28-01-2016 2/3 deposited Rs.2,62,029/- and co-villager of the informant and others deposited Rs.35,007/- in different accounts on persuasion of the petitioner in Jyoti Jan Kalyan Self Help Group a non-banking organization.
It is submitted by learned counsel for the petitioner that the petitioner was not connected with the alleged chit fund company and during investigation it was found that the alleged chit fund company was running in the house of Rabindra Singh. None of the alleged accounts bear signature of the petitioner and the petitioner was not, in any way, involved in the said non-baking company.
Subsequently, Nagendra Kumar and Rajiv Kumar undertook to return the amount of the informant and Nagendra Kumar has been granted bail vide Cr. Misc. No. 47337 of 2015. Considering the fact that the petitioner is not named in the FIR, whose name subsequently sprang up during investigation, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
