Present case has been lodged on the basis of complaint petition filed by the informant. In complaint petition, informant levelled allegation of rape against the petitioner and four others but when her statement under section 164 of the Cr.P.C was recorded, she made allegation of rape against only co-accused Ashraf Ansari and it is only stated against the petitioner that he along with others kidnapped her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case no. 197/2013.
