JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, on 17.05.2021 at about 12:30 PM, while the informant was at her house, all the F.I.R. named accused persons including this petitioner, armed with deadly weapons, came there and attacked on her, as a result of which, she sustained injury.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and no such occurrence, as alleged in the F.I.R., has taken place and entire F.I.R. is false

Patna High Court CR. MISC. No.10602 of 2022(2) dt.22-04-2022 2/2 and concocted. The present case is counter blast of Uphara P.S. Case No. 24 of 2021 lodged by petitioner himself against sons of informant. Petitioner and informant are own gotiya and admittedly, there is land dispute between the parties. Petitioner claims clean antecedent and is in custody since 12.01.2022 and investigation in this case is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Daudnagar, Aurangabad in connection with Uphara P.S. Case No. 23 of 2021.
