Petitioners are languishing in custody for offences punishable under Section 279/308/272/273/120B of the Indian Penal Code and Sections 30(a)/32(2)/38/47 of the Bihar Prohibition and Excise Act, 2016.

From the auto rickshaw of the petitioners forty liters of liquor was recovered.

The petitioners are in custody since 19.11.2016. Petitioners have stated on oath that they have got no criminal antecedent.

Considering the aforesaid facts, let petitioners, above

Patna High Court Cr.Misc. No.8574 of 2017 (3) dt.10-04-2017 2/2 named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Barachatti P.S. Case No. 461 of 2016, with condition that petitioners shall file undertaking at the time of furnishing of the bail-bonds before the Court-below that they would not indulge themselves in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
