JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143,188,448,323 and 353 of the Indian Penal Code.
The prosecution case is that the mob blocked the road. Some of the persons were identified by the chowkidar when seven persons were named and they obstructed the public servant in discharge of official duty. Though the petitioners are named in the FIR but the FIR is against 40-45 unknown also. It is submitted by the learned counsel for the petitioners that the accusation is against the mob. Statement has been made in
Patna High Court Cr.Misc. No.4108 of 2016 (2) dt.29-01-2016 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Jehanabad P.S. Case No. 456 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
