JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2019 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Anisul Haque, for the State. Against the order of cancellation of license of the petitioner to run his PDS shop, the petitioner has preferred an appeal before the District Magistrate, Nalanda at Biharsharif on 13.08.2018.

The aforesaid appeal has still not been disposed

Mr. Thakur, learned Advocate has very fairly submitted that though the writ petition has been rested on other grounds as well but since the appeal is pending before the appellate authority, the petitioner would be satisfied if a direction be issued to the concerned authority / appellate authority to dispose off the appeal at the earliest, preferably within a period of three months of the production of a copy of this order.

There is no reason why the appeal against the order of cancellation of license be kept pending for an unusually long period.

In the aforesaid circumstances, the concerned respondent, i.e. Respondent No. 2, is directed to dispose off the appeal filed by the petitioner, within a period of three months of the production/receipt of a copy of this order. With the aforesaid observation / direction, this petition stands disposed off.
