This application is for grant of bail in connection with Chapra Town P.S.Case No.539 of 2016 for the offence under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016. It is submitted on behalf of the petitioner that he is Driver of the Truck and he has nothing to do with the seized articles. He is in custody for more than three months.

Heard learned A.P.P. also, who has opposed the prayer for bail, stating that about 851 ltrs. of English wine have been recovered but he is only Driver of the said Truck. Having heard both sides. In view of the recovery of a huge quantity of English liquor, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his

Patna High Court Cr.Misc. No.2951 of 2017 (3) dt.27-02-2017 2/2 prayer for bail after six months.

Accordingly, this application is dismissed.
