JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-04-2023 The present writ petition has been filed seeking the following relief:- "1.That by the present writ application the poor and helpless senior citizen petitioner craves indulgence before this Hon'ble Court for issuance of a writ in the nature of prohibition strictly directing the Respondents to make any construction of some part of school building of primary School Madhubaria on the personal land
Patna High Court CWJC No.15122 of 2016(2) dt.05-04-2023 2/3 of the petitioner, situated at MauzaMadhubaria of Thana No. 655, Khata No. 44, Plot No.223 in Uchkagawn Block of District-Gopalganj as construction of aforesaid some part of school building is forcibly being made on the personal title holding lands of the petitioner, in dictatorship manner without acquiring the said lands.
And further for issuance of a writ in the nature of mandamus directing the respondents to remove the entire part of such unauthorised construction at once, which has been illegally made on the personal land of the petitioner in unauthorized manner, and to pay the appropriate cost and compensation for unnecessary mental, physical and economical harassment done by the illegal acts of the respondents."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent-authorities for redressal of his grievances. Liberty so sought is granted.
