The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, about 519 litres of liquor was recovered. While Ansu Rai @ Ankush Rai and Safique Ansari were apprehended other accused persons managed to escape. The accused who were caught disclosed that the petitioner was amongst the accused who managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who was not arrested at the spot. The petitioner is in custody since 29.12.2020 and has no criminal

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Kudra P.S. Case no. 397 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise Act, Kaimur at Bhabua.
