JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this petition, so far as petitioner no. 1 namely Md. Afsar Quraishi @ Md. Afsar Raza is concerned.

Accordingly, in respect of petitioner no. 1, this petition is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned Addl. Public Prosecutor for the State.

The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.10580 of 2022(2) dt.08-08-2022 2/3 registered for the offence under Sections 341, 342, 323, 308, 379, 504, 506/34 of the Indian Penal Code.

As per the prosecution case, all the F.I.R. named accused persons including these petitioners are alleged to have taken away the brother of the informant and after assaulting him with iron rod & danda, confined him in a room and also threatened him with dire consequences.

It is submitted on behalf of petitioners that allegation is general and omnibus. Parties are on litigating terms and just to put pressure on petitioners' side, the present case has been filed.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts & circumstances as well as general & omnibus nature of allegation, let the above named petitioners no. 2 to 5, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, District - Gaya in connection with Barachatti P.S. Case No. 396 of 2021, subject to condition as laid down under
