2. The petitioner seeks bail in connection with Maheshkhunt P.S. Case No. 80 of 2022 dated 16.04.2022, instituted for the offence punishable under Sections 341, 323, 307, 427/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in short, is that, on 15.04.2022 at about 04:00 pm, the petitioner along with other co-accused persons went to the informant and fired gun-shot on the him with intention to kill which caused injury below left knee of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this

It is further submitted that there is no specific allegation against the petitioner rather the main allegation is against Ajay Yadav and Shekhar Yadav. Ajay Yadav is said to have fired on the informant which caused injury in the leg of the informant whereas Shekhar Yadav was an order giver. It is further submitted that the allegation against the petitioner is general and omnibus in nature. Lastly, it has been submitted that the petitioner is in custody since 24.07.2023 and he has three criminal cases against him and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st, Class, Khagaria in Maheshkhunt P.S.
