The petitioner seeks bail in Bachhwara P.S. Case No. 72/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.

Surendra Roy the informant named 09 persons including the petitioner Sunil Kumar Roy @ Lalu and alleged that all the accused persons began to assault the informant and others. It is further alleged that Sunil Kumar Roy @ Lalu and Vinod Roy assaulted Sudhakar Roy with iron rod on his head. Learned counsel for the petitioner submits that there is counter version being Bachhwara P.S. Case No. 76/2016. The petitioner Sunil Roy and Vinod Roy are alleged to have assaulted Sudhakar Roy on his head with iron rod, but only one injury is

Patna High Court Cr.Misc. No.12511 of 2017 (3) dt.02-05-2017 found on the head of Sudhakar Roy. The injury is of course grievous in nature.

Considering the facts aforesaid and the fact that two persons are alleged to have assaulted with iron rod, but only one injury is found and there is counter version, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Begusarai in connection with Bachhwara P.S. Case No. 72/2016.
