The petitioner seeks bail in connection with Mojahidpur P.S. Case No.367 of 2019 registered under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 2575 bottles, each containing 300 ml. country made liquor, and 20 bottles, each containing 375 ml. Indian Made Foreign Liquor, from the vehicle, which was being driven by Rajendra Sah, in which the petitioner was found sitting.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is disabled person and after taking lift, he sat in the said vehicle and he had no knowledge about

Patna High Court CR. MISC. No.10154 of 2020(2) dt.02-03-2020 2/2 keeping of the liquor in the said vehicle by its driver. The petitioner has no criminal antecedent and is in custody since 30.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II,-cum-Special Judge, Excise Act, Bhagalpur, in connection with Mojahidpur P.S. Case No.367 of 2019.
