JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 385 and 387 of the Indian Penal Code. Allegation against the petitioner is that he demanded ransom from the informant and on failure of the same he threatened the informant and his son to kill them. Referred mobile is of the petitioner and in paragraph 24 of the case diary the police has recorded, on the basis of call details, that several times phone was called from the mobile of the petitioner. The petitioner has got four criminal cases as his antecedent and he is in judicial custody since 4.6.2016.

Considering the nature of allegation against the

Patna High Court Cr.Misc. No.5518 of 2017 (4) dt.24-04-2017 petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail in connection with Imadpur P.S. Case No.21 of 2016 pending in the court of learned C.J.M., Bhojpur (Ara) is refused.

The learned court below is directed to expedite the trial and conclude the same preferably within nine months from the date of receipt of this order failing which the petitioner would be at liberty to renew his prayer for bail before the learned court below itself.
