The petitioner seeks bail in Madhuban P.S. Case No. 184/2016, registered for the offences punishable under Sections 385, 387 and other sections of the Indian Penal Code. The informant alleged that he got a call from mobile no. 9576020504 by which the caller demanded extortion of Rs. 5,00,000/-. The case was lodged against the holder of aforesaid mobile.

Learned counsel for the petitioner submits that the petitioner is not the owner of SIM no. 9576020504. The petitioner was apprehended and his confession was recorded. Save and except confession of the petitioner there is no material against the

Patna High Court Cr.Misc. No.15809 of 2017 (2) dt.25-04-2017 petitioner. The Investigating Officer has not made any investigation with regard to holder of the aforesaid mobile from which extortion was demanded. The petitioner is in jail since 30.11.2016.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Motihari East Champaran in connection with Madhuban P.S. Case No. 184/2016.
