JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 414/ 399/ 402 of the Indian Penal Code and Section 25(1-b)a /26(1) /35 of the Arms Act. Allegation against the petitioner alongwith other accused persons is said to have recovered motorcycle without paper and illegal fire arms and they were making plan of committing illegal activity.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the police had recovered one country made pistol and one live cartridge from the conscious possession of the petitioner. The petitioner is languishing in

Patna High Court CR. MISC. No.20100 of 2021(2) dt.01-09-2021 2/2 judicial custody since 09.12.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition. The co-accused has been granted bail by the learned court below itself.

Learned APP for the State vehemently opposed the prayer for bail application.

Considering the custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Manjhagarh P.S.
