2. The petitioner has preferred this application for grant of regular bail in connection with Naubatpur P.S. Case No. 21 of 2024 dated 11.01.2024 registered for the offences punishable under Sections 363, 365 of the Indian Penal Code and later Sections 302, 201 read with Section 34 of the I.P.C. was added.
3. As per the prosecution case, the informant alleged that on 06.01.2024 her minor son aged about 17 years had gone out with one Ajit Kumar but did not return back till date, and when the informant called Ajit on his mobile, he said that he was out of station and the informant's son was not present with

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in this case on mere suspicion. Nothing has been recovered from the conscious possession of the petitioner. The occurrence took place on 06.01.2024 but the FIR was lodged on 11.01.2024 i.e. the delay of five days and there is no explanation for this delay. The charge-sheet has been submitted against the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody in this case since 02.05.2024.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that during the course of investigation the petitioner was apprehended and he confessed his involvement in the alleged occurrence along with other coaccused persons and told police that they committed murder of the informant's son and buried his dead body in Chhoti Nijai Bagaicha at Ibrahimpur. As per the post-mortem report of the deceased, the cause of death is due to combined effect of head injury and asphyxia due to strangulation, however the viscera
Patna High Court CR. MISC. No.9865 of 2025(3) dt.11-09-2025 3/3 was preserved for chemical analysis. The witnesses have stated that the deceased was last seen alive with the petitioner on the motorcycle near the shop of Mithilesh Mahto. Further, at the instances of the petitioner, the dead body of the deceased was recovered.

Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Naubatpur P.S. Case No. 21 of 2024, pending in the Court of learned A.C.J.M.-IV, Danapur, Patna.
7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
8. The application stands rejected.
