2. Petitioner seeks regular bail in connection with Mirganj P.S. Case No. 413 of 2024 dated 13.09.2024 registered for the offences punishable under sections 303(2) and 318(4) of the Bharatiya Nyaya Sanhita (in short 'BNS').

3. As per the prosecution story, the informant alleged that on 08.09.2024 at about 12:00 noon, he was going to Patna by his Innova car for its servicing and while on the way, two persons took lift from him to Doriganj, who later snatched his car, mobile and cash by making him unconscious.

4. The main submissions advanced by petitioner's counsel are that the instant matter relates to the offences

No.9595 of 2025(3) dt.12-05-2025 2/3 punishable under sections 303(2) and 318(4) of BNS and the petitioner has been falsely roped in the alleged offences and he was not put on Test Identification Parade before the informant, who is said to be the sole victim and the FIR was registered against unknown. It is further submitted that though against this petitioner, there are criminal antecedents of five cases but he is on bail in all the said cases and further, these cases relate to the year 2009 and the instant matter relates to the year 2024.

On the other hand, learned APP for the State has opposed the bail prayer of the petitioner with saying that during the course of investigation, on the basis of technical surveillance of the mobile phone of the informant which was also snatched by the accused persons, the petitioner's brother, namely, Dipak Kumar was arrested on 16.10.2024, in whose statement, the name of the petitioner surfaced and thereafter, the police recovered the snatched Innova car at the disclosure of this petitioner from a particular place. It is further submitted that the petitioner has remained accused in five cases, in which most of them relate to the offence of theft.

6. Heard both the sides and perused the FIR and case diary of this case. Considering the seriousness of the occurrence appearing from the FIR and also the incriminating material

No.9595 of 2025(3) dt.12-05-2025 3/3 appearing against this petitioner as pointed out by learned APP as mentioned in the paragraph No. 42 of the case diary coupled with petitioner's criminal history, this Court is not inclined to release him on bail at this stage. Accordingly, his prayer stands rejected.

7. The petitioner may renew his bail prayer after examination of the informant in his trial, if the same has started. (Shailendra Singh, J) annu/- U T
