The petitioner apprehends his arrest in connection with Sabaur (Goradih) P.S. Case No.123/14 for offences punishable under sections 376, 483, 328 and 307 of the Indian Penal Code. The petitioner is charged with having physical relationship and sexually assaulting informant for last one year and it is the allegation of the informant that when she pressed him for marriage then he administered some poisonous substance mixed with water which made her lose conscious and she was admitted to the hospital where the FIR has been instituted. No case for anticipatory bail is to be made out.

The petition is dismissed.

The petitioner should surrender before the Court below and pray for regular bail which should be considered on its own merit and be disposed of without being prejudiced by the order passed in the present proceeding.
