The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, as a result of indiscriminate firing by the four named accused persons including the petitioner herein as also 10 others, it is stated that one of the bullets hit the nephew of the informant who was trying to hide himself. The informant's nephew died on the spot. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is in custody since 21.10.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Maranchi (Pach Mahala OP) P.S. Case no. 47 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Barh.
