JUSTICE SUDHIR SINGH ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 366A/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping daughter of the informant either for marriage or illicit work or for sale.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 29.3.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. The alleged occurrence is said to have taken place on 24.8.2014. The victim girl is said to have returned to her parents on 29.8.2014. After a period of ten days she was produced by her parents before the police and thereafter, her statement under Section 164 of the Code of Criminal Procedure was recorded. There is no explanation on behalf of the prosecution in respect to the delay in producing the victim girl before the police. From perusal of paras-
Patna High Court Cr.Misc. No.23956 of 2015 (3) dt.17-12-2015 2 / 2 8, 94 and 95 of the case diary it is evident that one Rahul Kumar, co-accused, was in love affairs with the victim girl and the girl had left the house along with said Rahul Kumar. As far as petitioner is concerned, he is said to be one of the associates of the said Rahul Kumar.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case no. 220 of 2014.
