The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

On the alleged date and time of occurrence, all the F.I.R. named accused persons including these petitioners, armed with weapons, abused and assaulted husband of informant. It is further alleged that they also snatched motorcycle, mobile phone, gold chain and cash of Rs. 17,500/- from informant's husband.

Patna High Court CR. MISC. No.11221 of 2023(2) dt.17-05-2023 2/2 It is submitted on behalf of petitioners that present case is counter blast of Harlakhi P.S. Case No. 215 of 2022, which was lodged by petitioner no. 1 against husband of informant and others. Allegation of abuse and assault is general and omnibus. No specific allegation of overt act has been alleged against these petitioners. Petitioners claim clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Benipatti, District - Madhubani in connection with Harlakhi P.S. Case No. 248 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
