The petitioner apprehends her arrest in a case registered for the offence under Section 171-C, 171-H, 307 & other allied sections of the Indian Penal Code and Section 9 of Bihar Control of the use and play of loudspeaker Act, 1955. As per the F.I.R., on 26.10.2021, this petitioner alongwith other F.I.R. named persons entered in the Block premises for her nomination and they were playing songs by DJ in loud voice and on objection made by informant/BDO, they started nuisance and tried to kill the informant by pressing her throat and this petitioner was accompanied with her husband. It is submitted on behalf of petitioner that petitioner has been falsely implicated due to political rivalry. The alleged occurrence took place on the date of nomination for the post of

Patna High Court CR. MISC. No.10609 of 2022(2) dt.08-08-2022 2/2 Mukhiya. The allegation is general and omnibus and on the direction of other Mukhiya candidates, the aforesaid case has been lodged. Petitioner is lady and elected Mukhiya of Jaja Panchayat and claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Kadwa P.S. Case No. 251 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
